Can my HOA stop me from building an ADU in Jacksonville?

Updated October 2026

Yes, it can. Jacksonville's 2022 ordinance allows ADUs except where a homeowners association prohibits them, so a covenant against second units generally wins over the city's permission. It depends on what your declaration actually says: many restrict additional dwellings or require architectural approval, and some say nothing at all.

Why can an HOA override the city?

Zoning is a public rule about what the city allows. Covenants are private restrictions recorded against the land, which every owner in the community accepts with the deed. Jacksonville's ordinance was written to respect them: reporting on its passage said ADUs are permitted except where an HOA prohibits them.

What should I look for in my HOA documents?

  • Single-family-only language. Phrases limiting each lot to one single-family dwelling.
  • Outbuilding limits. Rules on detached structures, their size and location.
  • Leasing rules. Limits on renting, minimum lease terms, or bans on renting part of a lot.
  • Architectural review. A requirement to get approval before any exterior change.
  • Amendments. Newer amendments can change older restrictions, so read the latest recorded set.

What does Florida law say about HOA architectural review?

Florida homeowners' associations are governed by Chapter 720 of the Florida Statutes. Section 720.3035 deals with architectural control; as we read it, an association's power to review and approve plans reaches only as far as its governing documents provide. That makes the exact wording of your declaration the key question. For a firm answer on your community, ask a Florida real estate attorney.

What if my HOA allows ADUs but needs approval?

Then the order matters. Get architectural approval first, with plans that match the community's standards for roofing, siding and colors, and then file with the city. We prepare drawings that serve both reviews.

Do older neighborhoods have HOAs?

Many older Jacksonville neighborhoods have no active HOA, though some have old deed restrictions. Newer master-planned subdivisions across the region are far more likely to have active associations with detailed rules.

When does an HOA not matter?

It depends on whether there is one, and what it covers. If your lot has no association and no recorded restriction against second units, the city's rules decide. We check recorded restrictions during the lot check.
