ADUs in Jacksonville Beach, FL

Jacksonville Beach writes its own ADU rules, and they are narrower than the city across the Intracoastal. Here is what its code says.

Does Jacksonville's ADU ordinance apply at the beach?

No. Jacksonville Beach is its own city with its own land development code, and reporting on Jacksonville's 2022 ordinance noted that it does not apply to the Beaches. An ADU here follows Jacksonville Beach rules and goes through the city's own planning and building departments.

Where does the Jacksonville Beach code allow ADUs?

In the zoning text we reviewed, as of October 2026:

  • RM-1 and RM-2: accessory dwelling units are a conditional use, on the same parcel as a single-family dwelling only (Sec. 34-614 and 34-615).
  • C-1: an auxiliary dwelling unit is listed as a permitted use (Sec. 34-617).
  • RS single-family districts: we did not find ADUs listed.

A conditional use goes through a separate review, with standards in Sec. 34-546 and following, before a building permit. We check your parcel's district first, since it decides whether an ADU is possible at all.

Single-family home: A single-story house with white stucco walls and a brown garage door

What makes building at the beach different?

  • Flood zones. Much of the island sits in mapped flood zones, which set the floor height of new living space.
  • Coastal control line. Parcels near the ocean, seaward of Florida's coastal construction control line, can need a state permit from the Department of Environmental Protection.
  • Wind. Coastal sites often fall in a wind-borne debris region, which calls for impact-rated or protected windows and doors.
  • Small lots. Narrow lots leave little room once setbacks are applied.

Is an ADU realistic on my Jacksonville Beach lot?

It depends on the district. On an RM-1 or RM-2 parcel with a single-family home, the conditional use path is open. On an RS lot, a second unit may not be allowed, and a guest room inside the house could be the practical option. We tell you which case you are in before you pay for design.
